General Terms and Conditions

1. Scope of these T&Cs

Our General Terms and Conditions (T&Cs) apply to all services rendered by Canela Brown AG (“Le Picot”, “we”, “us” or “our”). Once a contract is made in accordance with the following provision, our relationship with you is subject to these T&Cs as amended at the time of order. Any alternative provisions made by the contracting parties are therefore invalid. By submitting an order to Le Picot or lepicot.com, you, as our customer, confirm that you have read and expressly consent to these T&Cs. Please take the time to read them.

2. Conclusion of contract

Contracts are made by us accepting your order via our website lepicot.com or through contact with Le Picot. We confirm our acceptance of your order by email, and your order is subsequently binding. If we experience any difficulties with delivering goods or providing our services, we will inform you as soon as possible by email. By submitting your order, you confirm that you are aware of the scope and contents of your order. If you have any questions regarding the contract, your order or other matters, please contact us to clarify them. Please also check in case you do not receive our emails or our emails are delivered to your spam folder. We assume that you receive our communications in our email contact with you.

3. Delivery of goods

We deliver ordered goods by courier, from our warehouse in Cham (Switzerland) for deliveries within Switzerland or Granada (Spain) for deliveries to the rest of the world. If an item from our product range is unavailable in exceptional cases, we will inform you as soon as possible by email. We reserve the right to make partial deliveries or to not deliver items not available to us. If an ordered item cannot be delivered within a reasonable period, we undertake to reimburse you for the purchase price.

4. Price information

We expressly reserve the right to adjust the stated prices without prior notice or further explanation. As a matter of principle, prices are calculated on the basis of the time an order is submitted via the website. If a price has patently been entered incorrectly, we reserve the right to cancel relevant orders

5. Customs and other charges

Within the European Union and Switzerland, we deliver our goods inclusive of customs charges, VAT and other charges. Deliveries outside these countries may be subject to customs and other charges and taxes, which we will pass on to you either on a prorated basis or in full.

6. Foreign currencies

We state the prices for our goods in our domestic currency, i.e. Swiss francs (CHF), as well as in euros (€).  The exchange rate applied to the conversion is not equivalent to the daily rate applicable on the given date; instead, the exchange rate is set by us at our discretion in the long term.

7. Return of delivered goods

You may return ordered items to us within a period of 14 days, stating the reason for the return. This does not apply to sale items, which cannot be returned. Items returned to us in clean and impeccable condition can be exchanged, provided that our stock allows, or you can have the purchase price reimbursed to you. Items can only be returned in their original packaging, provided that both the packaging and its contents are in impeccable condition and suitable for resale.

If you live in Switzerland, you can return items to us at our Swiss address. If you live in the rest of the world, please return items to our warehouse in Spain. The detailed addresses can be found here:

Any costs and charges for returning items from abroad (postage, customs, VAT etc.) are entirely at your expense. Important: When returning items from abroad, i.e. from outside the EU in case of returns to Spain and from outside Switzerland in case of returns to Switzerland, make sure that you mark the customs declaration as “returned goods”. Also make sure that you enclose copies of your proof of purchase so that the competent staff at your postal or courier service is able to make the appropriate customs declaration for the package.

We expressly ask you to verify without delay as soon as you receive your delivery that your delivery is consistent with your order and the enclosed delivery note, and that it is free from manufacturing defects and any transport damage. Please notify us of any incorrect deliveries, defective items or transport damage without undue delay and return the relevant items to us. Items must be returned to us unused and complete and in their original packaging.

Incorrect delivery

If incorrect items have been delivered, we will deliver the correct item to you, if possible. Alternatively, if the ordered item is no longer available, we will reimburse you for the purchase price once you have returned the item.

Defective items

If you receive defective or damaged items from us, you must these items to us together with a description of the defect within 5 business days from receipt of the items. We will check the items for the stated defect before confirming any warranty claim you may have. If we confirm that there is a warranty claim for returned items (defective material or workmanship), we will remedy the defect, replace the item(s) or reimburse you for the purchase price at our sole discretion. If a defect is not covered under a warranty claim, we will return the item to you without delay and free of postage.

Transport damage

You must notify us by email of any transport damage within 48 hours from receipt of your order. The email must contain a detailed description of the damage and photos as proof of damage. This notification is required for your entitlement to have the item(s) replaced free of charge or to be reimbursed for the purchase price.

The postage for returning any items to us for any reasons is always at your expense. You will be reimbursed for any postage upon request if the returned items constitute an incorrect delivery, defective items with confirmed warranty claim or items with transport damage

Items are returned at your risk.

Any other relevant provisions are in accordance with the Swiss law of obligations.

8. Warranty

The warranty for items ordered from Le Picot covers defective materials and workmanship. It is consistent with generally applicable standards and extends over a period of 12 months, unless explicitly otherwise stated. The warranty period starts from the delivery date. Le Picot reserves the right to take individual decisions on warranty claims.

9. Minor variance

Le Picot reserves the right to make minor changes to the design of its products and the type of the service to be rendered.

10. Product care/handling

Le Picot accepts no liability if you fail to care for and/or handle delivered items appropriately. Please note the relevant instructions to maximise the durability of your clothing.

11. Reservation of title for delivered goods

Delivered goods remain Le Picot’s property until full payment has been made.

12. Registration

We offer the option of registering free of charge to make repeat orders of services via lepicot.com as easy as possible. Upon registration, you will obtain a personal customer account with Le Picot. Your customer account is a password-protected area in which you store your personal data. The account is only accessible to you and Le Picot. Registration facilitates the ordering process, as you do not need to enter your data again with every new purchase. Registration is free of charge and without obligation. We will delete your personal customer account at any time upon your request without requiring you to state reasons.

13. Data protection

The data obtained from our customers is only used internally and not made available to any other companies or persons etc. We process and store personal data in compliance with applicable data protection laws. When you place an order, data such as order numbers or your login data is transmitted to our server. We encrypt this data with the SSL (Secure Socket Layers) security system to ensure that it cannot be read by unauthorised persons. Please use a browser which supports SSL. All popular browsers do so.

14. Amendments of T&Cs

Please note that we reserve the right to amend these T&Cs at any time without prior notice. When a contract is made, it is subject to the T&Cs applicable at the time the order is placed.

15. Applicable law/place of jurisdiction

The relationship between you and Le Picot is subject to Swiss law in any event, in accordance with the provisions of the Law of Obligations and Civil Code, excluding the provisions of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Zug, Switzerland.
